Traffic Law

Danielle recently acted for a client charged with driving contrary to an alcohol interlock licence, careless driving causing injury and failing to stop and ascertain injury. The client had a conviction history which included serious traffic offending but after seeking a sentencing indication he was sentenced to 18 months' intensive supervision, reparation of $444.80, emotional harm of $1000 and the minimum mandatory disqualification period of 1 year and 1 day was reduced to 6 months after the Judge made a finding of special reasons.

Drink Driving

Danielle was instructed to act for a client who crashed his car into the fence at Eden Park Stadium. When police arrived he admitted to drinking and driving and his breath alcohol test returned a result of 813 micrograms of alcohol per litre of breath, which is over double the legal limit. The client had left the vehicle and then come back to it over an hour later which is when the police arrived. There was insufficient proximity between the driving and the breath testing procedures which resulted in the charge being withdrawn and the client being able to keep his criminal record clean.

Criminal Law

Danielle’s client was a woman in her early twenties who was charged with burglary. Her brother and an associate had broken into a luxury brand store, stolen handbags and convinced her to drive the getaway car. After getting to know the client and her parents, Danielle learned that she suffered from fetal alcohol spectrum disorder. This was a contributing factor to her offending due to her difficulty identifying the consequences of her choices and her poor judgement skills. After receiving Danielle's detailed written legal submissions and supporting affidavit evidence, the court was persuaded to discharge the client without a conviction and her criminal record remained unblemished.

Limited Licences

Danielle was representing a client who had lost his driver's licence for driving with excess breath alcohol. The Police were seeking to include a clause in his limited licence which required him to keep to all posted speed limits. While this may not seem like a lot to ask, it meant that if the client was pulled over for speeding, then not only would a fine and demerit points apply but he would also have lost his limited licence without the ability to apply for another one. In addition to this he would face a charge of driving contrary to a limited licence which carries a conviction, maximum fine of $4,500, 3 months' imprisonment and disqualification for a minimum of 6 months. Danielle pointed out to the Police that clause 12 of the Chief District Court Judge's Practice Note stated that blanket conditions such as this were not generally appropriate as they must be case specific. The Police accepted that the client did not have a history of exceeding the speed limit so they were persuaded not to insist upon the inclusion of this clause.
